OSM Responds To Namejacking Accusations

Unfortunately, under the draconian strictures of OSM's Terms Of Use Agreement, we cannot quote what they say without risking legal action.
OSM forbids any reposting of anything on their site. In fact, we cannot even post their TOUA here without also risking legal action from them.

Now, that's Open Source Media!

That is on hell of a behemoth of a TOUA.

2. Additionally all of the weblogs linked to by us are likewise protected. You must abide by all additional copyright notices or restrictions contained on this site and our linked weblogs.

Is new to me. Restrictive licensing placed on sites another website links to. I'd love to see that tested in court.

Do automated news aggreators count as 'copying' content?
What about search engines?
If you deep link to the OSM site without reading the EULA are you still liable? What about direct linking to pictures?

If Yahoo news were this strict LGF would have no content whatsoever.

ChuckieMonster climbs to the top of the tree on the backs of Yahoo news and MSM journos and then tries to pull the rope up after him.

DailyKos has a post about the OSM misnomer here

They also point out their own contrasting copyright notice at the bottom of DKos which says:

© 2005, Kos Media, LLC.
Site content may be used for any purpose without explicit permission unless otherwise specified.

(Which I just cut and pasted directly from their site in a overwhelming urge of irony..)
